Dissolution Flowchart — Mediation
Step 1: Initial Filings
Petitioner: File & Serve Petition for Dissolution of Marriage
Respondent: Within 30 days of being served with the Petition, File & Serve Response for Dissolution of Marriage
Step 2: Exchange Financial Disclosures
Within 60-Days of each party’s respective initial filings, prepare and exchange financial disclosures.
This timeline can be extended by written agreement of the parties.
After exchanging financial information, it is possible the parties may be required to file for Joinder of certain accounts and/or want to hire third-party experts to review/assess assets and accounts (i.e. forensic accountant, real estate appraiser, etc.)
Step 3: Mediation Meetings
The parties can begin discussing and negotiation division of property.
These meetings will continue as needed until all items are addressed and resolved.
It is possible the parties may want to prepare Stipulations & Orders regarding temporary issues such as child custody and visitation, support, etc.
Step 4: Final Judgment of Dissolution
Once the parties have come to agreements on all matters regarding division or property, support, and child custody, the Final Judgment of Dissolution can be prepared and filed.
Upon return of the Court Approved Judgment, the parties’ dissolution will be complete.
